Terms of Service

1. Agreement to Terms

By accessing or using Borobudur.ai, CampaignHQ, SalesHQ, ContentHQ, or associated APIs ("Services"), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or organization, you represent that you have the authority to bind such entity.

2. Use of Services & Meta Compliance

When using messaging services powered by the WhatsApp Business Cloud API, you agree to strictly abide by:

  • Meta WhatsApp Business Messaging Policy and Commerce Policy.
  • Obtaining valid user opt-in before sending outbound promotional messages.
  • Honoring user opt-out requests (e.g. "STOP" / unsubscribe keywords) immediately.
  • Refraining from sending prohibited content, spam, or unsolicited broadcasts.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, API keys, and access tokens. You must immediately notify us of any unauthorized access or security breach.

4. Billing & Usage Fees

Subscription and usage fees are billed in accordance with your selected plan or custom enterprise agreement. Messaging consumption charges (including Meta conversation fees and SMS gateway costs) are tracked transparently and invoiced accordingly.

5. Service Availability & SLA

We strive to maintain a 99.9% uptime availability for our core platform and dispatch infrastructure. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by third-party upstream providers (such as Meta Cloud API outages).

6. Limitation of Liability

To the maximum extent permitted by applicable Indonesian law, Borobudur.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Services.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be submitted to the jurisdiction of the courts of Jakarta, Indonesia.
